The plaintiff contracted with the estate of Edward • Malley, hereinafter called the defendant, to weather strip a hoúse and to do other work, and was injured. The question to be decided is whether the plaintiff at the time he was injured was working as an employee or an independent contractor.

The finding, with such changes as the plaintiff is entitled to, discloses the following facts: The plaintiff was a carpenter-and also installed weather stripping.
