The plaintiff alleges in his writ} that he is the owner of an undivided half of a grist-mill and privilege, and all the appurtenances thereto belonging, including the right to raise a head of water necessary for the same, by means of the upper dam on the outlet of Buggernut pond, and the right to “ all the water in said pond, except so much as shall be actually needed and used by a certain saw-mill there situated; and the exclusive right to all the water in said pond when the water is no more than four feet and six inches high in the flume of the said upper dam; ” that…
