— Appeal from a judgment of the County Court of Chemung County (Monroe, J.), rendered April 14, 1981, convicting defendant upon his plea of guilty of the crime of burglary in the third degree. Defendant was charged in an indictment with the crimes of burglary in the third degree and attempted grand larceny in the second degree. Defendant, represented by assigned counsel Carmody, entered a plea of guilty of the crime of burglary in the third degree in full satisfaction of the indictment.
