This cause is now before the Court on defendant South Central Bell Telephone Company’s (SCB) “Motion for Summary Judgment, or in the alternative, for Partial Summary Judgment," and defendant Bobbie Carr’s (Carr) “Motion to Dismiss for Failure to State a Claim or for Judgment on the Pleadings or for Summary Judgment.” The plaintiff, Charles W. Burris (Burris) and Novelties, Unlimited, Inc. (Novelties) filed this suit in the Circuit Court of Lamar County, Mississippi against SCB and its employee, Bobbie Carr, seeking actual and punitive…
