(after stating the facts as above). 1." As will be seen from the above statement of facts, the 11th item of the will creates what is known as a “spendthrift” trust. There was no positive or direct proof before the trial judge that the sons of the testator were of weak minds or of intemperate or wasteful and profligate habits.
