BRENNAN, District Judge.
Through the medium of an order to show cause, the defendants seek a summary judgment dismissing plaintiff’s amended complaint.
This action may be termed an offshoot of an action previously brought by the plaintiff against the Oneida National Bank and Trust Company of Central New York. The first claim for relief in the above action requires the determination of plaintiff’s claim of ownership of a bank account standing in the names of one Fijalkowski, now deceased, and the plaintiff. The defendant, Arthur J. Foley, is now the executor of the Estate of said Fijalkowski.…
