Before the court is defendants’ motion for summary judgment (Doc. 17). Having been fully briefed and argued, the matter is ripe for disposition.

Background

This case arises out of an incident between plaintiff and officers of the Carlisle, Pennsylvania police department. At approximately 6 p.m. on October 20, 2006, Plaintiff Richard Shultz suffered a seizure while visiting a McDonald’s restaurant located in a Wal-Mart in Carlisle, Pennsylvania.
