*63These are contested election cases, and as they involve in substance, the same matters, they are disposed of in one opinion.

In the first-mentioned case, Johnson and Brice were opposing candidates for the office of county register. The latter received the larger number of votes on the face of the returns, was declared elected, and received the certificate. Thereupon the former instituted a contest.

In the second case the parties were opposing candidates for the office of county court clerk. McMillan received the larger number of votes on the face of the returns, and the certificate of election.…
