Defendant owned a building wbieb he wished to have remodeled, and for that purpose had blueprints prepared by architects. Plaintiff, a building contractor, inspected the'building, examined the blueprints, and estimated that the remodeling would cost $39,000 and take 2 months. A written contract was entered into by which plaintiff agreed to furnish the labor and materials for and do all the remodeling, and defendant agreed to pay him on the basis of the costs thereof plus 10% for overhead and 10% for profit, the latter 2 items not to exceed $4,000 each on the work described in the contract.…
