OPINION

SWEET, District Judge.

Defendant Jack Gray (“Gray”) has moved, pursuant to Rules 12(b)6, 12(c), and 56 of the Federal Rules of Civil Procedure, for an order or summary judgment dismissing the complaint of plaintiff Dr. Nicholas J. Gonzalez (“Gonzalez”). As matters outside the pleadings have been presented to and not excluded by this Court, the motion will be treated solely as one for summary judgment.
