In the month of October, 1923, this action was instituted by the plaintiff to recover the sum of $1100 alleged to be due on contract entered into in June, 1922, by the defendant with the plaintiff for the purchase of a tractor engine. Subsequently, on November 14, 1923, the defendant appeared in the action and filed a general demurrer to the complaint which was by the court overruled and the defendant allowed twenty days within which, to answer.
