DECISION AND ORDER

LARIMER, Chief Judge.

These two cases, which I am consolidating for purposes of this appeal pursuant to Fed.R.Civ.P. 42(a) (made applicable to this proceeding by Fed. R. Bankr.P. 7042 and 9032), arise out of a Chapter 7 case involving debtor Aapex Systems, Inc. (“Aapex”). In Morin v. Frontier Business Technologies, Inc., 01-CV-6395, Bankruptcy Judge John C. Ninfo, II, issued an Order on July 5, 2001, granting the Trustee’s motion for summary judgment on his claim seeking to avoid a transfer of $11,853.97 made by Aapex for the benefit of defendant-appel lant Frontier Business…
