The defendants have appealed from a judgment of $3,500 damages for the death of Harold Black-more, son of the plaintiffs, which occurred as the result of an automobile casualty.
At 6 o’clock on the evening of July 15, 1938, Mervyn Brennan, who was then 19 years of age, was driving his father’s automobile southerly along Van Allen Road near Escalón in San Joaquin County, toward his home three miles south of the intersection of that road with Lone Tree Road.
