Adelina Garcia appeals the district court’s dismissal of her petition alleging racial profiling pursuant to K.S.A. 22-4611 against the appellees, Officers Michael Anderson and Charles Doull and the Garden City Police Department. The district court dismissed Garcia’s petition based on her failure to comply with the notice provisions of K.S.A. 2010 Supp. 12-105b(d) for a claim made against a municipality subject to the Kansas Tort Claims Act (KTCA), K.S.A. 75-6101 et seq. Garcia argues the notice provisions of the K.S.A. 2010 Supp. 21-105b do not apply to her racial profiling claim.…
