This action arises out of incidents in May 2014, when Defendant Resultly, LLC (“Resultly”), in its efforts to earn commissions through Defendant VigLink, Inc.’s (“VigLink”) participation in QVC’s marketing affiliate program, crawled QVC’s website in a manner that QVC alleges overloaded its servers and rendered its customers unable to access and use the website. Am. Compl. ¶¶ 1-3. QVC now seeks by this lawsuit to recover damages for the substantial losses it says were caused by Resultly’s actions. It has sued three defendants: (1) Resultly; (2)…
