The plaintiff in error, Jay Gould Brown, was indicted in the United States Court for the Central District of the Indian Territory for the -larceny of certain cattle.

Upon a trial in the district court of Atoka county, to which •court the case was transferred after statehood, the jury by their verdict found the defendant guilty, but failed to agree upon the punishment.

On May 2, 1911, the court overruled a motion for new trial, and sentenced the defendant to imprisonment in the penitentiary for a term of one year and nine months. From which judgment an appeal was perfected by filing in this…
