GRAVEN, District Judge.
This action is brought under the provisions of section 9 of the Universal Military Training and Service Act, 62 Stat. 614, 1948, as amended, 50 U.S.C.A.Appendix § 459(d), 1951, commonly referred to as the Veterans’ Re-Employment Act. The pertinent provision of that Act provides as follows:
“In case any private employer fails or refuses to comply with the provisions of subsection (b) or subsection (c) (1) [of this section], the district court of the United States for the district in which such private employer maintains a place of business shall have power, upon the…
