This case involves a suit brought by house owners against Darnall Realty. Damages were claimed on the ground that the real estate firm made a “sham” sale of plaintiffs’ property and thereafter mismanaged the property and rented it although only authorized to sell it.

The district court held there was no genuine issue of fact as to a sham sale and entered summary judgment with respect to such claim. The issue as to whether defendant-company mismanaged plaintiffs’ property and rented it without authority to so do was tried to the court without a jury.
