Appeal by the plaintiff, George T. Bacon, from a judgment of the Supreme Court in favor of the defendant, the Montauk Brewing Company, entered in the office of the clerk of the county of Hew York on the 27th day of April, 1908, upon the report of a referee dismissing the complaint as to the said defendant.

This action is brought to recover on four promissory notes alleged to have been made by the defendant Montauk Brewing Company on the 12th day of September, 1906, payable in one, two, three and four months respectively to the order of Eurich’s Eort Iiamilton Brewery and indorsed by it and by one Edward H. M. Boehr,.who was the president of the maker, which notes were delivered to the Duluth Brewing and Malting Company before maturity and after maturity-were assigned to. plaintiff. The other defendants did- not appear on the trial. The Montauk company by its answer put. in issue…
