The defendant had approximately $600 on deposit in a bank. He issued to Various persons who are not parties to this action a large number of checks, totaling an amount far in excess of the deposit. A sufficient number of these cheeks to exceed the deposit were presented 1o the bank at approximately the same time, and the bank refused payment on all of them, giving as 'a reason its inability to determine which checks to honor or which to dishonor.
