WIENER, Circuit Judge:
Plaintiffs-Appellants are the parents of Aaron Moore, a minor, (collectively, “the Moores”) who, they allege, sustained serious injuries as a result of excessive exercise imposed as punishment by his middle school gym teacher. They ask us to reverse the district court’s summary judgment dismissal of all their claims. We affirm the court’s grant of summary judgment for the Moores’ failure to state a constitutional claim of deprivation of substantive due process under the Fifth or Fourteenth Amendments to the U.S. Constitution,1 but we reverse the district court’s exercise…
