Plaintiff, Mark Hughes (“Hughes”), alleges that Defendant, Life Insurance Company of North America (“LINA”), in bad faith denied Hughes long-term disability benefits. In our Entry of February 29, 2000, we held that Hughes’ claims were completely preempted by the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001 et seq., and that the factual allegations in plaintiffs complaint were sufficient to state a claim for benefits under ERISA § 502(a)(1)(B) (29…
