This case is before the court on defendants’, The Trustees of Purdue University and Purdue University (collectively Purdue), Motion to Dismiss filed on December 1, 1986. That motion is premised upon Rule 12(b)(6) of the Federal Rules of Civil Procedure. The plaintiffs filed a memorandum in opposition to Purdue’s motion on January 4, 1987; on the same day, Purdue filed a supplemental brief in support of their motion.
