Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered April 9, 1998, upon a verdict convicting defendant of the crimes of murder in the second degree, attempted murder in the second degree and assault in the first degree.

Following a jury trial, defendant was convicted of murder in the second degree (intentional murder) for the shooting death of Akil Bomani and attempted murder in the second degree and assault in the first degree for shooting Omar Greenidge.
