Opinion by Justice CARTER.

Tommie Joe Seagraves appeals his conviction for theft greater than $1,500.00 but less than $20,000.00 — a state jail felony enhanced by two prior felony convictions to the punishment range of a second degree felony. The punishment range for a state jail felony is not more than two years or less than 180 days’ imprisonment. See Tex. Penal Code Ann. § 12.35(a) (Vernon Supp. 2010).
