Appeal from a judgment of the district court and from an order denying plaintiff’s motion for a new trial.

The action arises out of a head-on collision on December 16, 1957, 4Vi miles north of Worthington, Minnesota, in which both drivers were killed. There were no witnesses as to the exact happening of the collision, which occurred between 8 and 9 a. m. on a clear morning, on a highway which is straight and level with no obstructions to vision.
