HAMITER, Justice.

In this petitory action the plaintiff, John M. Forrest, seeks among other things to be decreed the owner of approximately 55 acres of land situated in Rapides Parish and possessed by the defendant, Oscar M. Hunter. The disputed property is out of a larger tract of 205.45 acres owned at one time by Joseph W. Swann. From a judgment dismissing his suit, plaintiff has appealed.
