This was an action in county court of Nacogdoches county by appellee (defendant in error) against appellant (plaintiff in error) to recover damages for breach of contract to order out and accépt delivery of 375 barrels of flour; upon trial to the court without a jury, judgment was rendered for appellee in the sum of $419.33.
