MEMORANDUM OPINION

ERIC L. FRANK, Bankruptcy Judge.

I. INTRODUCTION

In this adversary proceeding (“the § 727 AP”), Robert H. Holber, the chapter 7 trustee (“the Trustee”), invokes 11 U.S.C. § 727(a)(2)(A), (3) and (5) 1 and requests that the court deny the discharge of Debt- or Neal M. Jacobs (“the Debtor”).

Presently before me is the Trustee’s Motion for Summary Judgment (“the Motion”), filed under Fed.R.Civ.P. 56(a). 2 As explained below, I conclude that the Trustee is not entitled to summary judgment on any of his claims due to the existence of genuine issues of material fact.
