DEVINE, Chief Judge.
At approximately 3:00 a.m. on January 21,1986, a group of students at Dartmouth College (“Dartmouth”) in Hanover, New Hampshire, dismantled with sledgehammer, crowbar, and hammer several “shanties” erected on the Dartmouth Green by other students protesting Dartmouth’s investment in companies doing business in South Africa.
