Each of these consolidated actions is brought in equity for an accounting of an alleged partnership. The first, in my memoranda deciding the issues, which memoranda will be *523in two parts, will be referred to as the Smith action; the other as the Maine action. The Smith action has been pending since February, 1928; it went to trial before the late official referee Isaac N. Mills in July of that year, and hearings were had between then and October 8, 1928.
