This appeal involves a contract dispute arising from a dredging operation at a dock at the port of Houston. De-Kaiz-ered, Inc. hired Continental Dredging, Inc. to dredge to a uniform depth of thirty-six feet in front of its dock in the Houston ship channel. Continental sued De-Kaiz-ered to compel payment pursuant to the contract. De-Kaizered alleged Continental breached the agreement, breached a warranty, denied liability under the contract, and countersued under the Deceptive Trade Practices Act (DTPA).
