This is a suit in equity for the rescission of a contract in writing, dated January 24, 1935, between Oliver Ericson of Oakland, Nebraska, and the Nebraska-Iowa Farm Investment Company;.for an accounting for certain specific property owned by plaintiff and delivered to and received *393by defendants named, pursuant to the terms' of the above contract, in trust and as agents of plaintiff; and also to recover certain secret and concealed profits made by defendants in handling plaintiff’s property as his agents and trustees.
