RIPPLE, Circuit Judge.

Vincent Reed, the defendant in a criminal prosecution under 21 U.S.C. § 841(a)(1), appeals a district court order denying his motion to vacate the sentence under 28 U.S.C. § 2255. On appeal, Mr. Reed raises three issues that he asserts warrant reversal: (1) whether the prosecutor’s decision to prosecute the defendant under federal rather than state law deprived the defendant of due process of law; (2) whether the statute under which the defendant was sentenced was unconstitutionally vague; and, (3) whether the district court should have applied the rule of lenity in…
