BOLIN, Justice.

Jeffery Hatfield was convicted of the capital offense of murder committed during a burglary, a violation of § 13A-5-40(a)(4), Ala.Code 1975. The trial court sentenced him to life imprisonment without the possibility of parole. Hatfield appealed. The Court of Criminal Appeals affirmed Hatfield’s conviction and sentence in an unpublished memorandum. (No. CR-06-1613, Dec. 7, 2007), 19 So.3d 265 (Ala.Crim.App.2007) (table).
