Rulon, J.:

Charles Hessenflow, executor, appeals various orders of the district court. We affirm.

The facts of this case are essentially undisputed and are as follows:

J.W. Hessenflow died testate on April 24, 1992, survived by three adult children and his second wife, Lorene Hessenflow. The decedent’s will with attached Consent of Petitioner was admitted to probate on June 9, 1992, at the request of his son, Charles Hessenflow.
