This is the second appeal of this ease. It is a contest between two gas companies, involving the right to supply the inhabitants of the city of Vernon with natural gas. The suit was originally filed by the Northern Texas Utilities Company (hereinafter referred to as the Utilities Company) against the Community Natural Gas Company (hereinafter referred to as the Community Company), seeking to enjoin the latter from laying its gas pipes in the streets of the city of Vernon.
