This case is before the court on Western Newspaper Publishing Co., Inc.’s (Western) petition for review of an order of the National Labor Relations Board (NLRB) denying Western’s application for attorneys’ fees and expenses under the Equal Access to Justice Act (EAJA or Act), 5 U.S.C. § 504. On October 29, 1985, the NLRB issued a supplemental decision and order adopting the recommended order of the administrative law judge denying Western’s EAJA application.
