I. INTRODUCTION
Plaintiff Constancia Simpson Hayes (“plaintiff’) instituted this employment discrimination action on December 3, 2009, following the Delaware Department of Labor (“DDOL”) June 22, 2009 Final Determination and Right to Sue Notice to plaintiff (D.I. 16, ex. 3) and the September 14, 2009 United States Department of Justice, Civil Rights Division issuance of a notice to plaintiff of her right to institute a civil action.
