FELDMAN, Justice.

Mast and Formentini (plaintiffs) brought a tort action against Standard Oil Company of California (defendant) and the Atchison, Topeka & Santa Fe Railway Company. The trial court granted summary judgment against plaintiffs. The court of appeals, 140 Ariz. 19, 680 P.2d 155, affirmed. We grantéd review with respect to the judgment in favor of Standard Oil Company of California only. We have jurisdiction pursuant to Ariz. Const. Art. 6, § 5(3) and Ariz.R.Civ.App.P., Rule 23.
