Defendant, Russell D. Roy, appeals the district court's order denying his third post-conviction motion for additional presentence confinement credit. We affirm.

I. Background

In 1999, Roy was charged with multiple drug offenses in two cases-Case No. 99CR321 and Case No. 99CR867. Under a plea agreement that disposed of both cases, Roy pleaded guilty to one count of possession with intent to distribute a schedule II controlled substance, a class three felony, in each case in exchange for dismissal of all other charges.
