The judgment in this case was rendered for a balance claimed on account of the purchase price of a carload of frozen fish sold by the plaintiff to the defendant, as to part of which there was a refusal to accept delivery and make payment. The sale included two hundred and eighteen boxes of fish, and by agreement they were placed in a cold storage warehouse in Philadelphia, where the plaintiff’s business was conducted, to await shipment on successive orders to the defendant in Baltimore. Deliveries aggregating one hundred and five boxes were made on the defendant’s orders, and seventy-seven…
