This appeal arises from the trial court’s order releasing excess funds from a tax foreclosure sale to appellee, Bayview Loan Servicing, LLC (“Bayview”). We affirm.

BACKGROUND

In February 2007, Priscilla Garibay-Crowell executed a promissory note payable to The CIT Group/Consumer Finance, Inc. (“CIT”). The promissory note was secured by a “Home Equity Deed of Trust” executed by Priscilla and Brian Crowell in favor of CIT “as lender” and Mortgage Electronic Registration Systems, Inc. (“MERS”) “as nominee for Lender and Lender’s successors and assigns.”…
