OPINION

CHAPA, Justice.

Ernest M. Cloughly and Spencer-Cloughly Investments appeal from an adverse judgment rendered against them on two promissory notes, three writs of garnishment, and the dismissal of their counterclaim and third-party claim.

Appellee, NBC Bank-Seguin (NBC) originally sued to recover the principal balance due on two promissory notes, one of which had been personally executed by appellant Cloughly; the other had been personally guaranteed by him.
