This is an action to foreclose a real estate mortgage. The case arose in the following manner: On December 29, 1928, D. V. York gave the' Citizens State Bank of Altus a note, secured by a mortgage on property in Altus, for $1,571. Payments were made on the debt from time to time until it was reduced to $905 on November 27, 1929, at which time a renewal note was made for the balance due. The bank was declared insolvent and taken over by the Bank Commissioner on February 3,1930. Payments were made on the note until the balance due on October 16, 1930, was $505.
