This is an action brought by the plaintiff, who had been a guest at the defendant’s hotel, against the defendant hotel company, as an innkeeper, to recover damages occasioned by the loss of a part of the plaintiff’s baggage from the hotel. The case was originally instituted in a Justice Court, and there are, therefore, no pleadings. On appeal to the County Court, and upon trial before the judge thereof, without *307a jury, the court found the issues, generally, for the plaintiff and further found specially that the plaintiff “was a guest of the defendant company, and…
