The plaintiff was convicted of the crime of obtaining money under false pretenses, in the district court of Yalley county, and sentenced to imprisonment in the penitentiary. The charge in the information on which he was convicted is as follows: “That on or about the 12th day. of March, in the year of our Lord one thousand eight hundred and eighty-six, in the county of Yalley and state of Nebraska, *521one William Cowan unlawfully and feloniously did falsely pretend to the First National Bank of Ord, Valley county, Nebraska, a corporation organized under the laws of the United…
