In the case now submitted to our consideration, we will enquire, first, whether this injunction was properly granted; and secondly, if it was, whether such measures have been since adopted, by the defendants, that it ought to be dissolved.

1. The plaintiff claims, that the road was never laid out, in the manner prescribed by the charter; and that the appraisal of damages was wholly void. These allegations were found to be true, and were the grounds on which the injunction was granted.
