Appellee Anthony Bercheny pleaded guilty to criminal charges in Michigan state court. He entered his guilty plea after the prosecuting attorney agreed to make certain concessions in the handling of his case. The trial judge reviewed and approved this agreement before imposing sentence. After sentencing, however, Bercheny felt that the state had neglected its obligations under the plea agreement.
