Pending before this court are cross-motions for summary judgment filed by defendant Lowe’s Home Centers, Inc. (“Lowe’s” or “defendant”) (Doc. No. 30) and plaintiff Joel J. Sabbrese (“Sabbrese” or “plaintiff’) (Doc. No. 33).
